The hearing was called to order at 8:05 p.m.

#1460                           Omnipoint Holdings, Inc.                        2R General Edwards Hwy. 
Seeks special permit approval relative to a proposed wireless communication facility.  Applicant proposes a 120-foot monopole telecommunication tower.  Property is situated in the Light industrial Zone within the Groundwater Protection District.

Kate Rugman, attorney for Omnipoint, is continuing till June 9, 2004.

New Cases

#1486                           McAvoy, John                                    13 Marie Ave.
Seeks two findings and a special permit relative to a proposed structure replacement on a non-conforming lot.  Property is situated in the Single Residence B Zone within the Groundwater Protection District.

Notice Read
BOH letter read and no objections.
Conservation Commission letter read and a Letter of Intent will need to be submitted prior to the building permit, otherwise there are no objections.

Joe Kent, Town Building Inspector, submitted a letter, which was read and is included in the application package.

Applicant explained the situation that the house is shifting and they discovered that the house is built on a landfill; therefore, it was determined to replace entire house.  The existing house is 40 x 27 (1080 sq. ft.), a 3 bedroom, 2 bath cape.  The house will be rebuilt to 40 x 28 (1148 sq. ft.), a 3 bedroom, 2.5 bath house.

Harris Cohen, neighbor of McAvoy’s, stated he feels they have a problem so it is a good idea that we help fix their problem.

Joan Higgins, neighbor of McAvoy’s, stated that it is a great idea to rebuild.


#1489                           Whitman Homes                           Glendale Road
Applicant seeks a Comprehensive Permit under MGL Chapter 40B, Section 20-23 for development of thirty-two town house condominium units, comprised of nine buildings, plus one existing home located at 9 Glenview Road.  Property is located off Rob’s Lane, Town of Sharon Assessor’s Map 102- Parcels 87, 88, and 92-1 and is zoned Residential B.

The notice was read and it was stated that the hearing will be continued till March 24th, 2004 at 8:00 p.m. in the Town Hall Lower Hearing Room.

Hearing Case:  Dan, John, Richard  Janis and Walter are alternatives.

#1472                           Old Post, LLC                           Old Post Rd.
Applicant seeks a Comprehensive Permit under section MGL Chapter 40B to allow a 66 unit, residential condominium development consisting of apartment-type units. Property is located on the eastern side of Old Post Road at the Sharon/Walpole town line and is in the L-I Light Industrial Zoning District.

New correspondence read:
·       Letter from the Board of Selectmen dated
·       Letter from Conservation Commission dated 3/9/04 regarding possible perennial stream
·       Peter O’Cain’s response to the Traffic Study dated 1/11/04

Ed Lyons, Falcon Association Architecture of Sharon described the project:
·       2 buildings on 18 acre site
·       33 units in each building
·       3 story entrance (atrium)
·       wood siding, earth tone colors
·       each unit has a balcony
·       each building will have community room and meeting rooms
·       units will be 1050 to 2020 sq. ft.
·       designed to be easily accessible
·       3rd floor will have stairs to loft and each building will have 2 available, 4 total

Dan requested to have the Age 55+ housing restriction law detailed out for the Board (1 – 2 page document).

Ed Lyons, continued with description:
·       basement will have 6 x 12 storage units available for the residences
·       landscape was described and shown on plans, screening to be done on Sharon side – Country Club has existing screening

Walter inquired regarding the paving that will be over part of the leaching field.  Gavin stated it would be vented.

Dan asked if one building was only built would the leaching field be paved.  Engineer stated some would still need to be paved over.

Mary-Ann Pearson, Walpole, stated opinion that it is naive to think that no children will be in the complex.

Al Pearson, 3 Hawthorne Dr., Walpole, stated that during the summer, the area is very congested with the Sharon Country Day School in session, especially during morning arrival and afternoon dismissal.

Maureen Smith, Baker St., Walpole, concurs with Al Pearson regarding traffic and asked for septic number clarification.

Gavin stated Title V will address that issue.  9820 is the total flow for the property.

Donna Pallatier, 833 Old Post, Walpole, concerned regarding foot traffic safety in area with development.

Ray Pallatier, Walpole, inquired regarding septic issues, will it flow to other properties.

Engineer stated they meet required setbacks.

Ken Fedik, is the architecture in line with other buildings in the surrounding area?
Dan inquired to what the cost would be for a waste treatment plan.

Gavin will ask client and get back to Board.

Linda Martin, Walpole, inquired how age restriction restricts septic flow.

Engineer stated septic flow is based on highest age restriction.

Gavin stated client will stay within the state restriction of 10,000 flow per day.

Hearing continued till 3/24/04.

Hearing stopped at 10:10 pm.

Next meeting scheduled on Wed., March 24 at 8:00 p.m. in Town Hall.
